These Terms of Participation (hereinafter the “Terms”) govern the legal relationship the University of Television and Film Munich (hereinafter the “Organiser” or “HFF München”) and the selected participant hereinafter (the “Participant”) in connection with the MunichFilmUp! 2026/2027 program (hereinafter the “Program”). They take effect upon submitting the application by the Participant.
Participation in the MunichFilmUp! 2026/2027 Program is open solely to film school students and to recent film-school alumni who have graduated no more than three years ago and who submit a complete application within the announced deadline.
The applicant shall declare any use of artificial intelligence (AI) tools in the preparation of the application at the time of application.
Late or incomplete applications shall not be considered.
The number of places in the Program is limited. Selection of Participants is at the Organiser’s discretion, and there is no legal entitlement to a place in the Program.
Once the applicant receives notification of selection, a binding agreement between the Organiser and the selected participant is formed.
Two of the Participants selected for the Program are students of the HFF München. Certain provisions on the coverage of costs under Clause 6 do not apply to HFF München Participants, as set out in that Clause.
The Participant shall take part in the Program activities, both in person and online, in accordance with the Program’s schedule and timeline, and shall attend all scheduled dates. Attendance is mandatory.

The Organiser shall communicate further details, including timings and online sessions, as part of the Program schedule.
The Participant may withdraw from the Program by giving notice to the Organiser via e-mail sent to mfu@hff-muc.de.
If the Participant withdraws, or, having been accepted, is unable to confirm participation and must cancel, the Participant has no entitlement to acceptance in any future edition of the Program.
As participation in the Program is free of charge, no participation fee is payable or refundable. The Participant is not entitled to any payment or other compensation in lieu of benefits that are not used as a result of a withdrawal or cancellation. Statutory claims of the Participant, in particular claims for damages arising from a breach of duty by the Organiser, remain unaffected.
The Organiser reserves the right to cancel or postpone the Program, or individual activities, where there are insufficient participants, where mentors are unavailable or for other good cause.
The Organiser may also make changes to the organisation and content of the Program – in particular to the schedule of individual activities, the assignment or replacement of mentors and the selection of venues and service providers – provided that such changes are reasonable for the Participant, having regard to the Organiser’s legitimate interests, and do not materially alter the overall character of the Program. The Participant has no right to any particular mentor, activity, venue or service.
Participation in the Program is free of charge. The Organiser shall cover the following costs of the Participant in full.
The return flight and the hotel room under paragraph a) are not provided to HFF München Participants.
The Organiser covers travel for the dates of the respective activity only and does not guarantee any financial support for changes to flights or travel arrangements made by the Participant.
The following costs shall be borne by the Participant and are not covered by the Program: health, travel and accident insurance; taxis to and from airports; transport between Nice and Cannes and back; daily allowances (per diems) for Munich and Cannes; and any cost not expressly listed above. Only the costs expressly listed in this Clause are covered by the Program.
The Participant retains all rights in their project. Neither the Organiser nor any member of its team, any mentor or any other participant of the Program acquires any right, title or interest in or to the Participant’s project, whether during or after the Program.
The Participant shall submit an evaluation report on the Program no later than one month after the official end of all Program activities.
The Participant shall provide at least ten photographs per person documenting their participation in the Program activities (in Munich and in Cannes). The Participant grants the Organiser a non-exclusive, royalty-free, worldwide licence to use these photographs to document and promote the Participant and the Program on social media, websites and other promotional materials of the Program. To the extent that the photographs show identifiable persons, the Participant consents to their publication for these purposes; such consent may be withdrawn at any time with effect for the future, without affecting the lawfulness of any use that took place before the withdrawal.
The Organiser shall be liable without limitation for damage arising from injury to life, body or health that is based on a negligent or intentional breach of duty by the Organiser, and for other damage that is based on an intentional or grossly negligent breach of duty by the Organiser.
In the event of a slightly negligent breach of a material contractual obligation – that is, an obligation the fulfilment of which is essential to the proper performance of the agreement and on which the Participant may reasonably rely – the Organiser’s liability shall be limited to the foreseeable damage typical of this type of agreement. Any further liability of the Organiser is excluded. These limitations of liability shall also apply in favour of the Organiser’s legal representatives, employees and vicarious agents.
Personal data shall be processed in accordance with the applicable data-protection legislation, in particular the General Data Protection Regulation and, where the Organiser is a Bavarian public authority, the Bavarian Data Protection Act (Bayerisches Datenschutzgesetz). These Terms, and any non-contractual obligations arising out of or in connection with them, shall be governed by and construed in accordance with the law of the Federal Republic of Germany, to the exclusion of the United Nations Convention on Contracts for the International Sale of Goods. Where the Participant is a consumer, mandatory provisions for the protection of consumers under the law of the country in which the Participant has their habitual residence remain unaffected.
To the extent permitted by law, the courts of Munich shall have jurisdiction over all disputes arising out of or in connection with these Terms.
If any provision of these Terms is or becomes invalid, illegal or unenforceable, in whole or in part, the validity of the remaining provisions shall not be affected. The relevant statutory provisions shall apply in place of any invalid provision. Any amendment or supplement to these Terms must be made in text form.
